Muller Technologies Customer Terms & Conditions (Summary)

1. Binding Agreement

By placing an order, registering, or accessing Muller Technologies services, you enter into a legally binding contract with Muller Technologies. These terms apply to both registered members and visitors.

2. Orders and Goods

  • Acceptance: Muller Technologies reserves the right not to accept any order. Acceptance is subject to the availability of goods, components, or repair parts.

  • Cancellations: Once an order is accepted, it cannot be cancelled or varied unless agreed to in writing by Muller Technologies. A reasonable cancellation fee may apply, particularly for specially sourced electronic components or specialized repair labor already performed.

  • Pricing: Prices for goods include packing, storage, and delivery as listed on the tax invoice. Muller Technologies reserves the right to increase prices if transportation, shipping costs, or international component import duties rise between the quotation and order acceptance dates.

3. Payment Terms

  • Payment Before Shipping: Standard terms require that full payment is received and cleared before any goods are dispatched or collected.

  • Account Facilities: A 30-day payment term from the date of invoice is only permitted for pre-approved customers who have successfully completed a credit application and been granted an account facility by Muller Technologies.

  • Interest on Overdue Accounts: Outstanding amounts on approved accounts will bear interest at the prime rate plus 2% from the due date until full payment is received in Rands.

  • Discounts: Any granted discounts are forfeited if payment is not made by the due date.

4. Risk and Ownership

  • Risk: The risk of loss or damage passes to the customer upon delivery. If a customer fails to take delivery (or collect a repaired unit), the risk passes when delivery is tendered or the collection notice is sent.

  • Title: Ownership of hardware, notebooks, or replacement components does not pass to the customer until Muller Technologies has received payment in full.

  • Software: Ownership or licensing of any software provided during support remains with Muller Technologies, its subcontractors, or its vendors.

5. Warranties and Liability

  • Warranties: Goods and replacement parts are generally warranted against defective materials and workmanship in line with the Original Equipment Manufacturer (OEM) terms (or 6 months if no OEM terms are specified). Repair services, including component-level motherboard repairs, are subject to the specific warranty terms provided at the time of service.

  • Limitation of Liability: To the extent permitted by law, Muller Technologies is not liable for indirect, special, or consequential damages (including data loss during repair) arising from the use of its products or services.

6. Customer Obligations

Customers are responsible for maintaining the security of their accounts and passwords and must ensure that all personal information provided is accurate and complies with the Protection of Personal Information Act (POPIA).
